THE TREATY OF WAITANGI Essays - Mori Politics, Mori History THE TREATY OF WAITANGI Her Majesty Victoria Queen of the United Kingdom of Great Britain and Ireland regarding with Her Royal Favour the Native Chiefs and Tribes of New Zealand and anxious to protect their just Rights and Property and to secure to them the enjoyment of Peace and Good Order has deemed it necessary in consequence of the great number of Her Majesty's Subjects who have already settled in New Zealand and the rapid extension of Emigration both from Europe and Australia which is still in progress to constitute and appoint a functionary properly authorised to treat with the Aborigines of New Zealand for the recognition of Her Majesty's sovereign authority over the whole or any part of those islands - Her Majesty therefore being desirous to establish a settled form of Civil Government with a view to avert the evil consequences which must result from the absence of the necessary Laws and Institutions alike to the native population and to Her subjects has been graciously pleased to empower and to aut horise me William Hobson a Captain in Her Majesty's Royal Navy Consul and I, Lieutenant Governor of such parts of New Zealand as may be or hereafter shall be ceded to Her Majesty to invite the confederated and independent Chiefs of New Zealand to concur in the following Articles and Conditions. Article the first The Chiefs of the Confederation of the United Tribes of New Zealand and the separate and independent Chiefs who have not become members of the Confederation cede to Her Majesty the Queen of England absolutely and without reservation all the rights and powers of Sovereignty which the said Confederation of Individual Chiefs respectively exercise or possess, or may be supposed to exercise or to possess over their respective Territories as the sole sovereigns thereof. Article the second Her Majesty the Queen of England confirms and guarantees to the Chiefs and Tribes of New Zealand and to the respective families and individuals thereof the full exclusive and undisturbed possession of their Lands and Estates Forests Fisheries and other properties which they may collectively or individually possess so long as it is their wish and desire to retain the same in their possession; but the Chiefs of the United Tribes and the individual Chiefs yield to Her Majesty the exclusive right of Preemption over such lands as the proprietors thereof may be disposed to alienate at such prices as may be agreed upon between the respective Proprietors and persons appointed by Her Majesty to treat with them in that behalf. Article the third In consideration thereof Her Majesty the Queen of England extends to the Natives of New Zealand Her royal protection and imparts to them all the Rights and Privileges of British Subjects. Japan is a country that is located on an island situated in the Pacific Ocean in East Asian with a population of 127.3 million people. The two major religions in Japan, which is one of the key elements that makes culture, are Shinto and Buddhism and the main language spoken is Japanese of course. The Japanese tradition dates back to thousands of years making it one of the countries that have the deepest traditions but at the same time non-resistant to the inevitable state of continuity and rapid changes associated with ever shifting fashions trends and technological advancements, which continuously pushes some solid boundaries, (Alston, 2015). Etiquette is an important aspect in Japan and therefore one has to do their best to be familiar with the basic rules before setting foot in the country if necessary. Because of its business culture, Japan is perceived as a difficult country to start business in by the foreign panies that aspire to venture in the Japanese business market. Business people as well as the local citizens of Japan are all generally service oriented making service the mainstay of Japanese business culture. It is not mon in the business culture of this country for someone to request for, give out, or even accept tips for the services they have rendered, this is one of the big differences between Japan and other countries’ business cultures, (Rowland 2014). In the case where one is getting ready to attend a business meeting, they have to consider the kind of first impression they will give. First impressions always begin with how someone conducts themselves in public, how they speak, how they dress and every other small thing that might not seem to matter to an outsider. An observer will tell that the Japanese have a conservative character which is fast enough but he or she will also notice that they are very formal in their dressing manner and mostly dress to impress. (Kunkel 2011). When selecting the type of business wear for a meeting, quality has to be considered. Women are expected to dress conservatively, avoid wearing pants, as it is offensive and not carry with you so many accessories. Women should avoid wearing high heels at all cost because they are not considered appropriate, (Azar 2016). In Japan, one’s attire and appearance can be associated with either having high corporate and social status or not. Japan has the hi ghest masculinity versus femininity score of 95; therefore as a woman with an intention to conduct business affairs in Japan, you will have to acknowledge the fact those traits such as effectiveness and petence. At some point, one has to take on the masculine traits, (Hanges 2013). It is therefore important to put in a lot of effort in that area and beware of what you are up against. In an occasion of any meeting related to business or any other affairs, the Japanese value high etiquette levels and protocol. In a business meeting, one should always avoid being too abrasive and brash but instead observe a conservative demeanour to gain the trust of other members of the meeting and be taken seriously whenever your opinion is required. It is important that one avoids flashy articles of clothing or flashy pens and when required to put something in writing, they should use the either the black or blue ink pens, not the red ink. When you enter, the room do not be the first to sit or be the only one left sitting while everyone else if standing, (Goldman 2014). You should follow what the other Japanese persons are doing if they are all standing up then do the same and if they are sitting down make sure to sit along., you should also wait to be directed on where to sit because mostly, the seating positions signifies the status of a person. Hofstede’s six dimensions of culture contains on that refers to the degree of inequality accepted between people with different levels of power. You should understand your place in the meeting with the highest person in the rank taking the lead or the head of the table and you as a subordinate will have to sit on one side of the table, (Vardaman 2014). During the meeting, listen carefully to what every member has to say and acknowledge their input and if necessary you can take notes of an idea said by someone else for clarity to make you part of the dialogue and give every   other person the impression that you consider the events as important as everyone else. The individualism versus collectivism dimension of culture among the six es in handy during such situations because by acknowledging individual a plishments and displaying expression of your own ideas freely will strengthen the ties you have with your Japanese host and the rest of the members in the meeting, (House 2013 ). Another vital etiquette is when meeting your Japanese host for the first time in person it is of great respect and importance that you first bow as it is observed in the traditions of the Japanese and wait to see if the other party to initiate a handshake or not. Bowing is a natural ting to them and you should not therefore assume and just offer a hand f irst, although some Japanese hosts will most likely offer a handshake considering you are a foreigner. Once the meeting s initiated, it is always considered a nice gesture to give your Japanese host a gift and if otherwise, thank your host and each individual involved to show them how much you appreciate the gift, (De 2013). It is not however a most that you carry with you a gift, but it would be smart and wise to carry one anyway. Use of nonverbal cues in nonverbal munication can be sometimes misinterpreted or misunderstood in the Japanese business culture. Excessive hand gestures and using the hands to add emphasis to words too much is to be avoided because of the reason that it is considered an informal way of conveying your message, (Genzberger 2014). Hand gestures also have their own meanings in the Japanese cultures for instance, the hand sign that is used to indicate okay in some other western countries actually means something else in Japan; it is a hand signal for money. In Japanese business etiquette, a smile carries many different interpretations and should therefore be done carefully not to send the wrong message in some business situations, (Engel 2013). Lastly silence is embraced in Japan and therefore one should not feel u fortable when suddenly the meeting room goes silent for some time as it one of their things. There are certain unspoken cultural expectations and rules that everyone needs to l earn before going to Japan and should be able to cope with anxiety because there definitely will be times when anxiety kicks in, this is explained in the uncertainty avoidance index among Hofstede’s six dimensions of culture, (Javidan 2013). The appropriate signs have to be well understood and the nonverbal munication in the business context interpreted carefully. (Kunkel 2011). Show the Japanese an effort that you are trying to understand their business etiquette and their culture. In general, despite the fact that they are usually very nice and forgiving towards foreigners, they deserve the respect which will put you in their favour and a better position with them in future. For the reason that a foreigner may not be part of the core Japanese family, one should strive to develop a high interpersonal connection to their Japanese host and take full responsibility of their actions and consequences as well as that of others; this is the second of Hofstede’s six dimensions of culture. A heavy emphasis on personal relationships is one of the key concepts shaping the Japanese business customs and culture and it is mon knowledge that social interactions is the basis of building any kind of relationship. Being a foreigner who is looking to establish and build a strong business relationship with the Japanese stakeholders, one has to keep in mind that there are rules to be considered and understood. In a social context where one is invited out for a social outing after a business meeting, turning it down is not a good idea and they should therefore make it possible enough to go. Building the right relationships fir future businesses somehow depends on how one interacts socially away from the business environment such as the workplace. When alcohol is involved, try to drink a little bit even if you are not a drunkard and never serve yourself a drink but rather wait for another person to do it for you. The indulgence versus restraint dimension es in picture at this point where people give themselves chances to enjoy themselves and have fun outside of work, (Dorfman 2013). Psychology and Computers For this paper I decided on the topic of how computers influence my chosen profession, and since I am a Psychology major this paper is going to be about Psychology and Computers. I plan to study School Psychology in particular. Where to begin? Computers affect so many aspects of Psychology. Let us start with the basic computer which is the calculator. We Psychology major’s use the calculator all the time, particularly in the class of test and measurements, are shown how to administer a test to students, adults, etc†¦ Then shown to calculate the different results and the different formulas we use and what the formulas mean. We also use the calculator, especially a calculator with graphing functions, to make graphs and to see what the math formula actually did. We can see what it measures and actually what the formula means. In another class called Senior research, we are using the ANOVA (Analysis of Variance) which is a data analysis tool that is located in the Windows Excel Program, to see if the outcome of the ANOVA was statistically significant or if the outcome of the just had to do with interference of other variables. Also in the Excel Program, after the outcome of the ANOVA we use the Chart Wizard to make a graph to show the results of the ANOVA. Those are just some of the things that I use everyday which require a computer in Psychology, and this is just undergraduate work. I have not begun to tell all of the influences that computers have on Psychology. I plan on going to Graduate school after I graduate from Lake Superior State University with my Bachelors of Science in Psychology. In Graduate school I plan - 3 - to study School Psychology, but just to get into Graduate school I have to take the Graduate Record Exam (GRE). This is a Computer Based Test which measures a students’ verbal, quantitative, and analytical skills. By using the computer test you will be able to get your results right away after you take the test, unlike when I took the ACT (National College Admission Examination) to get into Lake Superior State. The ACT was a paper and pencil test which took two to three weeks to get my test results back.

Management Challenges in Criminal Justice Essay

Abstract The criminal justice arena is made up of law enforcement, courts, and corrections and is vast as well as it is its own environment when referencing the leading or management of special groups. Numerous components within the criminal justice realm require team cooperation to be successful. In the law enforcement branch organized special groups such as Multi-agency gang and drug tasks forces, SWAT (Special Weapons and Tactics), CSI Crime Scene Investigation), and fugitive recovery units made up of cooperative entities of different agencies make up some of the organized teams of the law enforcement side of the criminal justice system. Courts are composed of prosecution teams, some of which specialize in specified criminal cases. Corrections are comprised of management that stresses both rehabilitation and incarceration as ordered by the courts. All of these organizations are composed of personnel trained as basic officers, then were chosen to be a part of a smaller, elite, and pinpointe d organized group. Management in a criminal justice agencies is a challenge all its own, managing smaller groups that carry specified responsibility within an organization carry different set of challenges. The criminal justice system is an environment that consists of law enforcement, courts, and corrections, though all are different entities, they strive to meet the same goal. The leadership within each of these entities has many challenges to face and conquer, one of which is that each has a different protocol when meeting the same goal of serving justice, yet each must accomplish this mission by different means. The challenge is the means by which each of the different branches is tasked to prove and execute their judiciary authority while maintaining a freedom of society. Legislation and courts place law enforcement at the forefront of detainment for a crime, which then puts the courts in motion. One challenge that is faced by management within the criminal justice system lies between the courts and the correctional branches. The challenge between the courts and correctional branches is the court system favors incarceration and the  correctional system emphasizes rehabilitation b ack to society. The common ground between these two branches is the teamwork between leadership that ensures the mission of each is completed and without out compromise of societies trust in the criminal justice system. Another challenge that management within such a vast system faces is budget shortages. These shortages affect all branches of the criminal justice system as well all levels including local, state, and federal authorities. Over the past several years most states have decreased funding as much as 15% as well half the states in the union have either delayed in filling judgeships or not filled them at all, thus forcing judges to sit on multiple bench roles, while other states were forced to lay off staff or take furlough (Associated Press, 2010). Management within these organizations is expected by society to provide adequate protection though their operating budgets are being decreased. Managers must find a motivation for their employees to complete tasks without incentive or praise whi le increasing responsibilities due to lack of potential man-power. Challenges such as ethnic environmental changes around the globe also have an effect on the criminal justice system both in this country and abroad. These changes brought about situations that the criminal justice system was not prepared for; at the top of this concern is terrorism. The first World Trade Center raised concerns about foreign terrorism in the United States, then domestic terrorism became an issue in 1995 with Timothy McVeigh’s attack on the Murrah Federal Building in Oklahoma City. Larger concerns were raised and changes demanded after September 11, 2001, when the most deadly terror attack in this country was spawned. The question was raised concerning the country being adequately protected against terror attacks of that magnitude. Confusion within the laws that were created from past terror attacks have led to accusations of innocent persons being part of terror organizations. Confusion arises because of a structure that allows for terrorists to slip through cracks and loopholes within the system (Wilson, 1985). This confusion causes leaders within the law enforcement community to balance the sides of the system that society has lost faith in. These managers would need to address issues, such as stereotyping of Middle Eastern persons and persons of questionable  faiths that society may associate with terror organizations. These leaders would need to encourage fair and unbiased treatment regardless of ethnical differences. A challenge that affects the criminal justice system, preferably the correctional branch, is facility overcrowding. Prison overcrowding is a major problem in this country as the massive bed shortage continues to grow at a rate of seven percent a year (Daniel Dunne, 2010). Overcrowding in prisons and jails area a constant issue due to the work of the law enforcement and court branches, in short, doing their jobs of incarceration and sentencing. Since this issue is caused by the other two branches fulfilling their sworn duties, there is no certain method currently available to solve this issue, thus it is for this reason that leaders within the two active branches must take into consideration charges and sentencing of an offender. Leaders within the correctional branch find overcrowding more difficult during budget crises where programs are cut or dismantled in efforts to save money. Some wardens and other correctional managers have resorted to double or triple bunking of prison cells, some managers find this a violation of the Eighth Amendment to the Constitution as it does reflect cruel and unusual punishment. As this crisis continues, managers continue to show frustration as courts continue to sentence offenders to institutions with reduced room to house them properly. The challenge mostly less obvious to the public is the political arena that criminal justice management faces. All three branches of the criminal justice system are affected by politics, from the legislation of laws to the employment of leaders within the system. Leaders must have the ability to adapt to both legal and political challenges (Allen & Sawhney, 2010). Most leaders and management of the criminal justices system are stuck in the middle between lobbyists for laws and annexations as well as other issues that benefit small entities of societies or communities but may not favor either as a whole. This political unrest faced by these leaders causes frustration, which leads to another challenge-communication to those employed in the system but not in management positions. Communication barriers between management leaders and the subordinate group are commonplace. In any occupation there are two types of communication; one from the individuals within the occupation the other is from the organizations within the occupation. Management must overcome the challenge of communication from individuals’ interpretation of messages through clarity and explanation and the manner for which it was delivered. All three branches of the criminal justice system have their own terminology, language, and interpretation of messages. The main challenge for leadership is interpretation and standardizing of specified language to keep these messages on an even keel. Communication is among the most important tool in the criminal justice system and each individual organization; any failure can have a devastating effect on multiple individuals from the organization to the victim(s). Therefore, communication must be clear and concise with everyone in the criminal justice s ystem with a strategy to overcome lapses. Aside from the language barriers within the criminal justice system come two of the greatest challenges faced by the criminal justice system go together, as one usually does not occur without the other. Ethnical and cultural diversity issues can have an effect on society but even more so with a system of authority that operates off of communication and laws that may not be adhered to by people from outside of the observing community or country. Since this country is majority multicultural, it is important for the criminal justice system to recognize and respect these cultures as they have contact with them. Because of this demand of recognition and respect, leaders within the criminal justice system must be open minded and go farther than the basic manager, they must become experts of these different ethnicities and teachers of their organized groups, thus educating them to better serving them as they have contact with them. Cultural diversity issues are the main argument in many criminal justice organizations. The lack of knowledge of groups lead to offense and distrust from groups towards authority, this then leads to hostility, non-compliance, and lack of involvement from communities of different ethnicities. For criminal justice agencies to be successful in a diverse environment, leaders must address religious differences, language differences, and cultural  traditions that may need to be taken into consideration. Lastly, the challenge of morality and ethics is always a concern for managing leadership in any organization. Management within the criminal justice system is always under scrutiny in reference to ethics and moral standards. Morals are instilled in individuals throughout life, ethics is taught through an organization’s environment. Leaders must find a happy medium when these two concerns clash and may cause a compromising situation. This common ground may need to appease both the moral of the organization’s personnel as well as the ethical conduct of the organization. Because the criminal justice field is held to standards higher than most of society, ethical conduct must be strict and understood when comparing to morals. Ethics will always be a concern, but superb leadership can stress adherence without improvising the system. In conclusion, challenges within the criminal justice system’s management and leadership are never ending. Leaders and managers are vicariously held accountable for subordinate’s actions and must remain diligent with solutions to problems. To maintain proper adherence to policy and procedures, leadership must be diligent in their efforts of education and communication of their subordinate employees as well as receptive to their ideas and solutions to issues that may be a challenge to the system as well. These solutions can be instilled through training and promotion of ideas via strong structured leadership and motivation from within individual organizations in their entirety. Analysis on Swift’s Attitude towards Humanity Introduction In1726, Jonathan Swift, one of the best-known realistic writers in 18th century, published his book Gulliver’s Travels which on the surface is a collection of travel journals of a surgeon called Lemuel Gulliver but actually is a work of satire on politics and human nature. In the four incredible adventures, Gulliver’s perceptions are tied closely with Swift’s shame and disgust against British government and even against the whole of the human condition as Richard Rodino says in his book that Gulliver is neither a fully developed character nor even an altogether distinguishable persona; rather, he is a satiric device enabling Swift to score satirical points. The European moralists say: â€Å"the nature is degenerated in these latter declining ages of the world, and could now produce only small abortive births in comparison of those ancient times† (Swift 187) In Glubbdubdrib, people can make ancients appears with magic, Gulliver makes conversation with ancients, and finds â€Å"As every person called up made exactly the same appearance he had done in the world, it gave me melancholy reflections to observe how much the race of mankind was degenerated among us, within those hundred years past†, â€Å"how all these pure native virtues were prostituded for a piece of money by their grandchildren† (Swift 271) Gulliver is thrown into deep melancholy as he discover the degeneration of human nature.
